!NOTES:
See THE MATTINGLY FAMILY IN EARLY AMERICA by Herman E. Mattingly (1975);
p. 60: "Ignatius, the sixth son of Thomas Mattingly II, was not of age at
the time of his father's death. Named last in his father's will (citing St.
Mary's Co., Md., Wills, Liber 14, folio 222 (1714)), Ignatius was probably the youngest of the six sons. After the Will of his father directed the disposition of the real estate and some of the personal estate, the residue was divided equally between the widow and Ignatius and his three brothers, Charles, William and Luke, and his sister Ann.
"Records of Ignatius are few. He was paid "for making a coffin" b yPhilip
Key, administrator for William Smith in 1745 (citing ibid Accounts, Liber 21,
folio 220 (1745)). He also recieved a payment from the estate of John Knott
of St. Mary's County, deceased, in 1749 (citing ibid Accounts, Libe r27, folio 22 (1749)). (A Samuel Mattingly was also named in the account. His relationship is not known.) Thomas Knott was the administrator. Ignatious Mattingly was listed as owing a debt to the estat eof Thomas Knott in 1750 (citing ibid Inventories, Liber 43, folio 2 87(1750)). In 1758 he was a witness to the will of Richard Cooper (ibid Wills, Liber 30, folio 558 (1758)). In 1773 Thomas Howard in his will (citing ibid Wills, Liber 39, folio 735 (1773)) mentioned a tract of land under a lease during the life of Ignatius Mattingly.
"Ignatius Mattingly was on the Rent Rolls of St. Mary's County fo rhaving
a 155-acre tract of land known as "Clever" which he had purchased from James
Bond Taylor April 2, 1751 (citing ibid Rent Rolls, Liber 7 & 8, Nos .1 & 2,
folio 86 (1723-1751)). He was also paying taxes on three parcels o fland in
St. Mary's County from 1754-1774 (citing ibid Debt Books, 1754-1774) .These
properties were known as "Clever," "Mattingly's Hope," and "St. John's."
"Ignatius was a witness to the Will of Richard Cooper in 1758 (se eabove).
In 1769 he and William Fowler were suretys for Jane Reever, administratrix
for Edward Reever (citing ibid Testamentary Procedures, Liber 43, folio 282
(1769)). Together with James Mattingly and Leonard Mattingly, sons of his
brother, Thomas Mattingly III, Ignatius received in 1773 from Leonar dWathen,
executor, a payment due from the estate of his deceased brother, William
(d.1771) (citing ibid Accounts, Liber 69, folio 208 (1773)). Court records
show that he was present in court in 1774 (citing ibid Provincial Court Judg-
ments, Liber JG #3, 1767-1778; Liber DD #20, p. 17). He was mentione din the
will of Thomas Howard in 1773 (citing ibid Wills, Liber 39, folio 73 5(1773)).
"Ignatius must have been seriously ill when he wrote his will Apri l2,
1789 (citing ibid Wills, Liber JJ #1, folio 470 (1789)), since he died soon
afterwards. The will was proven April 22, 1789. Witnesses were Robert Sax-
ton, husband of a niece, Ann Mattingly, the daughter of his brother ,William;
and Mary Inge (?). One shilling was left to each of three sons, Leonard,
Luke and William, and the same amount to two daughters, Elizabeth an dSarah.
The balance of the estate was divided between his son, Ignatius, Jr. ,who was
named executor, and his daughter, Susanna. No wife was named in th ewill.
"It seems that five of Ignatius Mattingly's seven children were am ongthe
early immigrants to Kentucky. No doubt they were already in the Wes tat the
time of their father's death. This is indicated by the father's bequests of
only one shilling each to Leonard, William, Luke, Elizabeth and Sarah. From
sources on the Kentucky Mattinglys, Susanna also must have gone to Kentucky,
but after her father's death.
"The first organized group of Catholics from Maryland to go to Kentucky
arrived there in 1785 and settled at Pottinger's Creek in Nelson County.
A Phillip Mattingly was in this group. The second group to go West arrived
in Kentucky early in 1786, and settled at Hardin's Creek, about ten miles
east of Pottinger's Creek. With this second group were Leonard, William
and Luke Mattingly. Their sisters, Elizabeth and Sarah, must have been
with them, or followed the next year or so. (Note: It is not here intended
to give extended genealogies of the Kentucky Mattinglys. There ar e anumber
of such studies, and much of what is given here is from them.) [JS: There

pg 44: "In his will of 1745 (citing St. Mary's Co., Md., Wills, Libe r24,
folio 95 (1745)) this James Mattingly designated his brothers, Thoma sand
Luke Mattingly, as sole executors of his estate, thereby making plai nthat
he was the son of Thomas Mattingly II (d. 1714) and the grandson of Thomas
Mattingly I (d.1664), the immigrant to Maryland.
"There are few records of the activity of this James Mattingly. Along
with William Knott, he was surity for J and (?) Knott, administrato rof the
estate of Francis Knott in 1724. (citing ibid Testamentary Procedure ,Liber
27, folio 38 (1724)). And in 1733 he was named in the will of Jame sKnott,
Planter (citing ibid Wills, Liber 21, folio 10 (1733)).
"In his own will of 1745 James made no mention of his wife. The children
would all appear to have been minors, since none were named executors. Seven
children were named to receive legacies. Two sons, James and Thomas ,received
"all my land" which was divided equally between them. Thomas received the
tract known as "Mattingly's Hope," which James inherited from his father,
Thomas II. The son, James, received the dwelling house and that par tof the
land on which it stood. This would seem to indicate that James was the eldest
son.
"All the rest of the personal estate was equally divided between " myother
five children," Ann, Monica (sic), Robert, Peter Sheircliffe, Jr., Peter
Ford and Clement Hill. Peter Ford was the brother of Anastasia who is supp-
osed to have married Luke Mattingly, brother of James (citing ibid Wills,
Liber 22, folio 239 (1735)).
"Rich. Cooper and A. Thompson presented an inventory of the estat e of
James Mattingly May 29, 1745 (citing ibid Inventories, Liber 31, folio 276
(1745)). William Mattingly and Luke Mattingly, brothers of James, were named
kindred. Creditors were Henry Bryson and John Toon. Debts were du eto the
estate by Ignatius Knott, Henrietta Knott, Monica Wimsatt, Henry Shircliffe
and Luke Mattingly.
"In April, 1746, Henry Shercliffe submitted to Court an account (citing
ibid Accounts, Liber 22, folio 175, 293 (1746)) of the estate of James Matt-
ingly with the will attached. Payments had been made by Monica Wimsatt and
James Walker. Disbursements were reported as made to Peter Ford, Henry Bryan,
Thomas Pain, Peter Mills and Luke Mattingly.
"An inventory of the estate was proven by Thompson and Cooper Augu st30,
1746 (citing ibid Inventories, Liber 33, folio 94 (1746)). Two day slater,
September 1, 1746, Henry Shircliff, administrator, swore to the trut hof the
inventory. It is strange that, eighteen years later, John, son of James,
brought suit in Court against Henry Shircliff for failing to bring a napprais-
ment of sundry effects belonging to the estate, and for not having submitted
a final account (citing ibid Testamentary Procedures, Liber 40, foli o211, 212,

and that of his daughter, Dorothy (cite). In her Will written October6, 1774, Dorothy mentions "my grandfather, Ignatius Doyn, deceased."She made a bequest "to my beloved sister, Ann Mattingly." Althoughher sister, Ann, is named executrix, her "uncle Edward Mattingly" wasasked to oversee some of the Will's designations. See The Mattingly Family in Early America, op.cit. p. 46:
John Mattingly was the forth son of James (d.1745). Father Walton 's
Diary gives the record of the marriage of John Mattingly and Ann Ford,
January 30, 1768. the Diary also has the record of the baptism on April 11,
1770, of Joseph Mattingly, son of John and Ann. The sponsors were Joseph
and Catherine Ford (cousins). A daughter, Elizabeth, was baptized Novem-
ber 2, 1771. The sponsors were Anthony Semmes and Elizabeth Spalding.
Father Walton's Diary further reveals that John and Ann Mattingly were
sponsors at the baptism of Eleanor Saxon, daughter of Robert and Elizabeth.
Some years after his father's death John was active in bringing He nry
Shircliffe, administrator of his father's estate, to Court for not submitting
a final account. Luke Mattingly, John's uncle, and his brother James, were
summoned to Court in behald of John's petition.
The record of John Mattingly's death in 1773 is found in Father Walton's
Diary. Ann Mattingly signed the administration Bond for her husband's
estate June 22, 1773. Athan, Ford was her surety in the amount of L200
sterling. John's estate was appraised July 9, 1773. James Mattingl yand
Robert Mattingly were named as kindred, and Ann Mattingly made oath to the
truth of the inventory November 5, 1773. John Mattingly's inventor ywas
presented in Court December 18, 1773. His widow, Ann, was summoned to Court
in 1775 relative to the estate. Again, in 1776, further court actio nwas
recorded in the matter.

!NOTES:
THE MATTINGLY FAMILY IN EARLY AMERICA by Herman E. Mattingly, 1975 , p25:
"John Baptist Mattingly was the son of Thomas Mattingly III and, m ost
likely, his second wife, Ruth Cole. John Baptist was born about 171 3on the
home plantation, "Mount Misery," in St. Mary's and received deeds o fgift
from his father July 7, 1745. However his father's Will (citing St .Mary's
County, MD., Wills, Liber 40, folio 99 (1774)) made a bequest of "m ylittle
slipe of land called "Mattingly's Lane", my water mill with the smal lparcel
of land adjoining thereto which I have purchased from Thomas Warren ,deceased,
and intended to have given to my son John Baptist Mattingly, but it being
omitted in my deed of gift ....and my son Edward Mattingly having since bought
and paid his brother John Baptist for the same with my other lands, my will
and desire is that my said son Edward and his heirs have and enjoy the afore-
said Mill and lands forever."
"A number of records give something of the activity of John Baptis tMatt-
ingly. He was one of the creditors for the inventory of the estate of his
brother, Thomas, submitted in Court August 4, 1756 (citing St. Mary' sCounty,
MD., Accounts. liber 62, folio 246 (1756). On March 1, 1757/8, he signed
the inventory of Thomas as next of kin. (citing ibid)
"Sometime before mid-1758 John Baptist Mattingly married Ann Spald ing
Fenwick, widow of Richard Fenwick. She was the mother of four mino rchildren
at the time of her marriage to John Baptist.
"In 1759 Ann Fenwick Mattingly rendered an accounting of her firs thusband's
estate. The value was given as over 353 pounds (citing St. Mary's County, MD.,
Accounts liber 43, folio 95 (1759)). Later that year an additional account
was recorded by John Baptist Mattingly "and Ann, his wife, lately Fenwick..."
They charged themselves with a balance of 167.13.4 3/4, and for tobacco paid
to James Clarke. They swore to the truth of the account May 3, 1759 ."The
orphan's names and ages and securities named in the previous accoun twhich
was then thought a full one." (Note: The previous account was not found.)
(Citing St. Mary's County, MD., Accounts. liber 43, folio 300 (1759)). What
was apparently the final account was submitted September 13, 1759, b yJohn
Baptist Mattingly and Ann, his wife (citing St. Mary's County, MD., Testa-
mentary Procedures liber 37, folio 298 (1759)). Elizabeth Spalding in her
Will of March 20, 1760, mentions her "beloved daughter" Ann Mattingl yandpart of the crop due me by John Bpt. Mattingly (citing St. Mary' sCounty, MD.,
Wills, liber 31, folio 1105 (1760)).
"There was a court matter between John Baptist Mattingly, lessee , and
George Graves, tenant, in 1760. No return was made by Graves. Late rappear-
ance was made by Graves and he made his defense (citing St. Mary's County, Md.,
Court Judgments, liber DD #1, folio 212, 330 (1760-1761)).
"John Baptist Mattingly of St. Mary's County was surety for John Baptist
Spalding, executor of Ann Spalding, February 11, 1761 (citing St. Mary's
County, MD., Testamentary Proceedings, liber 38, folio 98 (1761)). On the
same date he was surity for Elizabeth Miles, Executor for John Mile s(citing
Ibid. folio 99 (1761)). Also in 1761 John Baptist Mattingly was summoned
to Court to testify at the request of John Baptist Spalding against Henry
Spalding (citing Charles County, MD., Testamentary Procedures, libe r38,
folio 159 (1761)). [end page 24]
"John Baptist Mattingly signed an indenture with Meverell Lock o n May26,
1760, for the conveyance of "Grave's Swamp with Addition," a tract o f156 1/2
acres. Lock had previously bought the parcel from George Graves Jun e26,
1755. Later, on August 22, 1760, the deed for the tract, now calle d"Grave's
Swamp with Attition with Vacancy," containing 146 1/2 acres, was turned over
to John Baptist. Four years later, in March 1764, he signed a bond agreeing
to sell the same property to William Thomas. The bond was for 200 pounds
sterling and 34,000 pounds of tobacco. [The article continues with mention
of various land purchases and sales, court matters etc. On page 26 appears:
"...There is no John B. or John Baptist Mattingly in the Marylan dCensus
of 1800. It is presumed that he had gone to Kentucky, where a John Mattingly
was listed in the Census of Washington County that year."
[And on page 27:] "In 1939 Jesse E. White of New York City mad e agenea-
logical study of the John Baptist Mattingly family. He lists a son ,Gabriel,
born June 15, 1777, in Maryland. No documentation is given other than that
descendants of Gabriel in Kentucky asserted that he was the son of John
Baptist Mattingly. Nothing is known about the rest of the family listed in the
1790 Maryland census mentioned above. However, John Baptist's Will written
March 14, 1817, and proven in Washington County, KY., May 12, 1817, reveals
that there were at least two daughters still living at that time. They
were Elizabeth, who had married Elijah Yager, and Eleanor, who had married
James Ryan. Gabriel, the son, married Ann Julette Molohon, a nativ eof Mary-

pg. 12: "Judith Mattingly Turner. When Walter Pake entered the rights for
fifty acres for each of the immigrant Mattingly family (citing Land Records,
Liber DD, folio 106) (See Document III), the daughter, Judith, was listed
as Judith Turner. A search of records of the various Turner familie sin
the Province give cause to speculate about Judith's place among them.
"Thomas Turner, who died in 1662 (citing St. Mary's Co., MD, Wills ,Liber
1, folio 167 (1662)) left money to the priest, and money for Mass fo rone
William Johnson (deceased husband of Elizabeth Turner, [Thomas'?] daughter).
Among legacies was a tract of land called "St. Winifred's." Anothe rtract,
"Little St. Thomas," was given to his wife, Emma (Langworth) Turner .Luke
Gardner was the overseer for the Will. Children, besides Elizabeth Turner
Johnson, were Thomas and Mary.
"In 1696 another Thomas Turner, presumably the son of the Thomas w hodied
in 1662, died (citing St. Mary's Co., MD., Wills, Liber 7, folio 27 9(1696)
leaving his wife, Elizabeth, and three children, Thomas, Johua and Monica.
Legacies to the children included the tract, "St. Thomas," to the son, Thomas;
the tracts "Audley's End" and "Part St. Thomas" to Joshua; and the tract "St.
Dorothy," to Monica. In 1719 Cezar Mattingly sold "Mattingly's Hope "in
Charles County to Thomas Turner.
"It is interesting to note that in 1720 Thomas Turner is administrator of
the estate of Joshua (citing St. Mary's Co., MD., Accounts, Liber 3 ,folio
234 (1720). It can be speculated that Thomas was the brother of th edeceased
Joshua who died intestate and that he left no wife or children. Also, that,
if married, his wife may have been Judith Mattingly. Judith's nephe wwas
Thomas Mattingly III who died in 1774. We find the children of Thomas Matt-
ingly III possessing the properties listed in the foregoing records of the
Turner family. Thus, of the children of Thomas Mattingly III, Edwar dposs-
essed "Edley's End" and "St. Winifred's"; Clement had "St. Dorothy" and
"Part of Great St. Thomas"; Leonard had "Audley's End" and Thomas I Vhad
"St. Thomas." Since all of the tracts left by Thomas Turner (d. 1696) and
left to his children, Thomas, Joshua and Monica, are later in the possession
of the children of Thomas Mattingly III (d. 1774), a family connection may
be presumed; and, as already noted, Judith Mattingly Turner was the aunt of
Thomas Mattingly III."

daughter, Judith Parker. No other records are available about Judit hexcept
with regard to her administration of the estate of one Benjamin Clark.
"In presenting her administration bond for the estate of Benjami nClark,
she was given as Judith Clark, with Robert Cole and Thomas Mattingl yas her
sureties, August 8, 1709 (citing ibid Testamentary Proceedings, Libe r21,
folio 179 (1709)). However, on March 3, 1709, (citing ibid, folio 210 (1709)),
petitions were presented in court by Robert Parker and Judith, uxor eius (?)
("his wife"), administrators or executors of Benjamin Clark, deceased. An
inventory of the estate of Benjamin Clarke was taken August 16, 170 9(citing

"In August, 1710, "the account of Robert Parker and Judith his wif eadvise
all and singular the goods and chattels of Benjamin Clarke, late of St. Mary's
County, Gent., Dec'd" (citing ibid Inventory & Accounts, Liber 31, folio 357
(1710)). Payments were made from the estate for debts due (among others)
to Addams Clarke, Thomas Clarke, Francis Clarke, and Robert Parker .On August
14 "then came Robert Parker and Judith his wife, administrators of Benjamin
Clarke and made oath..." to testify to the truth of the account.
"(This Benjamin Clarke can hardly be the brother-in-law of Judith ,since,
according to her father's will of 1714, he was still living. Her father be-
queathed to his grandson, James Clark, the plantation "whereon his father
now dwells....").
"A Robert Parker was witness to the will of Anthony Johnson, Baltimore
County, in 1718 (citing Maryland Calendar of Wills, v. 5, p. 80 (1718)),
and to the Will of James Maclone, also of Baltimore County, in 1724 (citing

"Leonard Mattingly, oldest son of Ignatius Mattingly, Sr., was born inSt. Mary's County, Maryland, in 1739, according to the inscription onhis Kentucky tombstone. About 1760 he married Mary Hayden. A LeonardMattingly was surety on May 20, 1762, for John Ethelbert Knott, administrator for Clement Knott. If not our Leonard, it could havebeen his first cousin, Leonard, son of Thomas Mattingly, III.

Twelve children were born in Maryland to Leonard Mattingly and MaryHayden. They were John, Leonard, Basil, William, Joseph, Ignatius,Jane, Susan, Margaret, Elizabeth, Pollie and Sallie. Some few yearsafter arrival in Kentucky their mother died. Later, in 1812, Leonardmarried Dolly Hardesty (d. 1829). Two daughters are said to have beenborn of this second union, both of whom died in infancy. Leonard diedin 1829."

JS Note: On November 24, 1776, a John Mattingly was christened whoseparents are listed as WILLIAM and Mary Mattingly and who was sponsoredby Basil Payne, Sr. and his wife Margaret. There is no WilliamMattingly included in Herman Mattingly's book who was married to aMary nor whose age would be appropriate for a son born in 1776. It isfelt that the father of this John Mattingly was Leonard rather thanWilliam.

While I have little proof, I believe that Leonard and Mary (Hayden)Mattingly were close friends of Basil and Margaret Payne. Here wefind the Paynes sponsoring the baptism of a child or grandchild of theMattinglys. The Payne's son Basil Jr., married their daughter SarahElizabeth. Notice the names of their children which include aMargaret and a Basil.

They moved to Kentucky in the 1785/91 migration and were residents ofHardin's Creek, Nelson County, Kentucky.

"Luke Mattingly, the son of Thomas Mattingly II (d. 1714), was nam edin
his father's will. (citing St. Mary's Co., Md Wills, L. 14, f.222 (1714))
After legacies to sons Thomas and James and daughters Elizabeth Clarke and
Judith Parker, his father directed that four thousand pounds of tobacco be
given to Luke and his brothers Charles, William and Ignatius, and their
sister, Ann. These five children, along with their mother, were als odesig-
nated to receive the residue of the estate, equally divided among them.
Luke's father also stated that he desired all his male children to b eof age
at 18 years. This would seem to indicate that Luke, as well as his brothers,
was not of age in 1714. His birth, therefore, can be placed at circ a1700.
"It is speculation that sometime before 1735 Luke married Anastasi aFord,
daughter of Robert and Margaret. Her father in his Will (citing St .Mary's
Co., Md, Wills, Liber 22, folio 239 (1735)) written December 27, 1735, men-
tioned his daughter Anastasia Mattingly. Other connections with th eFord
family, and the naming of his daughter Anastasia, seems to confirm Luke's
marriage to Anastasia Ford. If this be so, Anastasia died sometime before
1744, since Luke married Priscilla Knott, widow of George Knott, on Novem-
ber 29, 1744 (citing St. Mary's Co., Md., Accounts, Liber 21, folio 139,
(1744)). George Knott was still living in 1738 (citing St. Mary's Co., Md.,
Testementary Procedures, Liber 30, folio 406 (1738)). Luke Mattingl yand
his wife, Priscilla, submitted the account of the estate of her deceased
husband November 29, 1744. (Citing St. Mary's Co., Md., Accounts, Liber 21,
folio 137 (1744)
"Luke possessed three tracts of land on which he paid taxes. (Citi ngSt.
Mary's Co., Md., Debt Books, 1753-1744) These were "Choice als Hazzard"
("Choice Part Hazzard"), 1753-1769; "Choice Part Hazzard," 1758-1766 ;and
"Howard's Mount," 1769-1774. In 1783 he petitioned for a survey of thirty-
five acres of vacant land adjoining "Howard's Mount" and also the land of
one Shertcliffe. (Citing St. Mary's Co., Md., Land Records, Liber I C#2,
folio 87 (1793) Although the date is the year after his death, Luk ereceiv-
ed a certificate of survey (citing St. Mary's Co., Md. Land Records ,Liber
IC #B, folio 148 (1784)) and a Patent (citing St. Mary's Co., Md., Land
Records Liber IC #A, folio 320 (1784)) for a tract of forty-two acre sknown
as "Partnership." This tract was among three in the Upper New Town Hundred
for which his son, Bennett, was assessed in 1793-1796.
"In his will (citing St. Mary's Co., Md. Wills, Liber JJ #1, foli o245
(1783)) written March 7, 1783, Luke named six children. They were Bennett,
Zachariah, Anastasia, Ann, Mary Ford and Elizabeth. He also named Dorothy
Knott "daughter-in-law." She was probably the daughter of his wife ,Pris-
cilla, by her former husband, George Knott. Luke bequeathed all hi sreal
estate to his wife (whom he did not name), and ordered that, upon he rdeath,
it was to go to his son Bennett. In turn, Bennett was to pay his brother,
Zachariah, six thousand pounds of tobacco. Bequests were made to hi sdaugh-
ter, Anastasia Spalding, wife of Joseph Spalding; to his daughter, Elizabeth
Spalding, wife of Thomas Spalding; to his daughter, Mary Ford Mattingly; to
his daughter, Ann Wimsatt, wife of Richard Wimsatt, and to his "daughter-in-
law" Dorothy Knott. Witnesses to the Will were John Allen Thomas, Elinore
Miles and Thos. Shircliffe. The Will was proven December 9, 1783, the widow
agreeing to stand by the Will as written. The two sons and the wido wwere
executors, and submitted an account in court October 19, 1787. (Citing St.
Mary's Co., Md., Accounts, Liber JJ #A, folio 32 (1787). [See Document
XVI, THE MATTINGLY FAMILY OF EARLY AMERICA, for the full will.]
"Priscilla, widow of Luke, died in 1790. Her Will (citing St. Mar y's
Co., Md., Wills, Liber JJ#1, folio 507 (1790)) was written October 23, 1790.
Benedict Spalding and Elias Smith were witnesses. Executors were he rsons,
Bennett and Zachariah, and her daughter Mary Ford Mattingly. The will was
proven December 14, 1790. In her Will Priscilla named the followin gchildren:
daughters, Jane Thompson (wife of Jesse Thompson) and Sarah Thompso n(wife of
Bennett Thompson), and "my three children" Bennett, Zachariah and Mary Ford.
It is interesting to note that she did not mention Dorothy Knott, no rthe
other three children, all of whom were married by 1783; namely, Anastasia
(wife of Joseph Spalding), Elizabeth (wife of Thomas Spalding), and Ann (wife
of Richard Wimsatt)."

!NOTES:
See The Mattingly Family in Early America op.cit. p46:
There are quite a few records of Robert Mattingly, fifth son of James.
He was named in his father's Will of 1745 to receive personalty. I n1761,
with his brother, Peter, he was a witness to the will of Henry Bryan . In
1762 the two brothers were listed as creditors in the inventory of their
brother Thomas, who died in that year. On February 3, 1763, Robert Mattingly
with Peter Ford, Jr., was surety for Eleanor Bryan, widow and executrix of
her husband, Henry Bryan.
It seems likely that Robert was married twice, first to Jane Cole,
daughter of Robert Cole, who was brother of Ruth Cole, wife of Thoma sMatt-
ingly III (uncle of Robert). Robert Cole, in his Will of 1771 name dRobert
Mattingly as his son-in-law (husband of his daughter, Jane). He als omen-
tioned their daughter, Catherine Mattingly. Robert Cole's will make sit
plain that his daughter, Margaret (who married Richard Melton), was dead
at the time of his will. He bequeathed personalty to the "heirs of my
daughter, Jane Mattingly and the heirs of my daughter Margaret Melton, and
my four children which are now living, viz., Henrietta Heyden, Eleanor Cole,
Elizabeth Cole and Mary Cole." He named his three sons-in-law Rober tMatt-
ingly, Richard Melton and Basil Hayden, "my true and trusty friends,"
executors of his estate. William Hayden was their surety in the amount of
L500 sterling.
Two of the four children listed by Robert Mattingly in his Will o f1776
were baptised by Father Walton, whose Diary has the entry under dat eof May
20, 1770 of Gabriel, son of Robert and Frances Mattingly, with Ignatius and
Bibiana Ford as sponsors. On April 22, 1772, Father Walton recorde dthe
baptism of Anastasia, daughter of Robert and Frances Mattingly, wit hAnthony
and Mary Semmes as Sponsors. Apparently the other two children name din
Robert's Will, Charles and Katherine, were the children of his firs twife,
Jane Cole. robert Mattingly and Jane Ford were sponsors at the baptism of
Joseph Ford, son of Robert and Sarah.
Robert Mattingly wrote his Will June 22, 1776. It was proven December 14,
1776. Although he did not name his wife, it is evident that she wa sstill
living. After his just debts were paid, he ordered that the residu eof his
estate be divided "between my two children Gabriel and Anastasia Mattingly,
my wife to have her third part." Further, robert bequeathed "my tw ochildren
Charles and Katherine Mattingly to my good friends Richard Melton an dBazill
Haydon, to be brought up." The Will, therefore, seems to indicat e adiffer-
ence between the two children, Gabriel and Anastasia, and the other two,
Charles and Katherine.
Bazill Haydon was named executor of the estate of Robert Mattingly .Philip
Ford and Leonard Booth were witnesses of the Will. Philip Ford and John
Baptist Thompson were sureties for Bazill Hayden, executor. The inventory
was presented in Court March 20, 1777. Bazill Hayden presented the account
of Robert Mattingly according to the minutes and Proceedings of Orphan's
Court, St. Mary's County, Md., 1777-1801, pp. 1 and 2. Sundry maso ntools
were included in the inventory presented by "Bazel Haydon" February 14, 1777.
Appraisors were Joseph Wathen and Joshua Graves. Creditors were George Booth
and R. Melton, Jr. Kindred were given as James Mattingly and Luke Mattingly.
It is possible that Robert's second wife was Frances Ford. John Ford, in
his will of 1782, mentioned Gabriel Mattingly and Anastasia Mattingl yas his
nephew and niece. Gabriel Mattingly was on the Maryland assessment lists
for 1796. The Census of 1800 gives both Charles and Gabriel in Prince George
County, Maryland.
Gabriel Mattingly married December 20, 1794, Eleanor Leigh. His brother,
Charles, married November 22, 1799, Ann Hazle. Although Peter and Robert
were dead by 1794, there was a Peter Mattingly and a Robert Mattingl ythat
year among the Easter Communicants at St. Inigoe's according to Father Walton's
list. There was also a Monica Mattingly listed. A Robert Mattingl ytook
the oath of Allegiance in 1778."

!NOTES:
See THE MATTINGLY FAMILY IN EARLY AMERICA by Herman E. Mattingly (1975).
Pg. 9: "The date of arrival in America of the First Mattingly famil yis
not exactely known. A search of passenger lists of all ships comin gto the
colonies during the early years reveals no Mattinglys. This might b eex-
pected, since to leave England at this time it was required that al lsub-
scribe to the oath of supremacy of the King. In that country itsel fsuch
a requirement had already produced many martyrs. And those seeking liberty
of religion in a foreign land were not likely to start off with wha twas
a denial of their Faith.
"At any rate, the first Mattingly family is found in Maryland in 1664. In
the family were the father and mother, Thomas and Elizabeth Mattingly, and
four children: two sons, Thomas and Cezar, and two daughters, Judit y(who is
given as Judith Turner) and Elizabeth.
"The head of the little family died early in 1664 without makin g awill.
The widow, Elizabeth, was given letters of administration (citing St .Mary's
Co., MD., Testamentary Procedures, Liber IE, folio 34 (1664), and sh esigned
an Executor's Bond July 24, 1664 (citing St. Mary's Co., MD., Testamentary
Procedures, Administration Bond, Box 1, folder 17, Hall of Records, Annapo-
lis, Md. {see appendix for copy}). A warrant was issued to William Rosswell
and Raphael Graywood to appraise the estate (citing St. Mary's Co., MD.,
Testamentary Procedures Liber IE, folio 76 (1664)), the inventory o fwhich
was presented for recording July 29, 1664 (citing same Liber folio 116 {see
appendix for copy}).
"The inventory indicates that the family did not have much of thi sworld's
goods. A cow, a calf, and a heifer make up the livestock possessed .A still
and all belonging to it was another item. Some tools, personal clothing, and
houseware made up most of the remainder of the inventory. Meanwhile ,the
widow, Elizabeth, married one Walter Pake(s), himself a widower. H eis given
as paying the doctor's fee, and the court costs in a record completing the
inventory of Thomas Mattingly (see Document II). (see notes of Elizabeth for
more information on Walter Pake and the family).
See at pg 11: "It is to be remembered that many early Maryland settlers
were indentured. This meant that their passage to the Province was paid
by some other person or persons. No doubt this was done to get mor epeople
to help in the task of colonization. After arrival, however, all those in-
dentured were required to work for those who paid their passage unti lthe
indenture was retired.
"Apparently, the Mattingly family, despite the restrictions long prevailing
against Catholics in England, had managed to save enough of this world's goods
to pay their own passage to Maryland. The family was not, therefore ,inden-
tured, and was immediately entitled to fifty acres of land for each member of
the family. The sickness and death of Thomas Mattingly, head of th efamily,
must have occurred shortly after his arrival in Maryland, since he had not
made application for the three hundred acres to which his family wa sentitled.
For this reason, as noted above, Walter Pake made the application fo rthe 300
acres."
"The death of their father shortly after arriving in Maryland, an dthe
tragic death of their step-father four years later, must have had some effect
on the four Mattingly children. Their ages at the time of the family's arrival
in the Province is not known. Judith was probably the oldest since she is
given as already married to a Mr. Turner. Nor is it known which of the boys
was the older, Thomas or Cezar, though Thomas is usually named first .Nothing
is known about the daughter Elizabeth."

Thomas Mattingly, second son of James Mattingly (d.1745), died i n1762.
His wife Margaret, signed an administrative bond June 2, 1762/3. A ninven-
tory of the estate was recorded June 21, 1762/3, and proven October 6,
1762/3. Creditors were his brothers, Robert and Peter. The inventory was
signed by John Sheircliff and Richard Millard. The widow, Margaret ,swore
to the truth of the inventory. The final account of the estate was sub-
mitted by the widow June 7, 1763. Two sons were named in the record ,James
and Richard, and they were designated as minors. A further recordin gis
found under date of October 29, 1763.
Nothing definite has been found about the two sons of Thomas. A Richard
Mattingly and a Richard Mattingly, Jr., were on the assessment roll sof
Washington County, Maryland, Cumberland Hundred, in 1763. A James Mattingly
was on the census roll of St. Mary's County in 1790, with one male under 16
years, and two white females, and four slaves. A James Mattingly wa samong

!NOTES:
THE MATTINGLY FAMILY IN EARLY AMERICA by Herman E. Mattingly, 1975 ,p. 30:
"Thomas, the first son of Clement Mattingly, was born March 28, 17 38.
Judging from the Will (St. Mary's County, MD., Wills, Liber JJ #2, folio
342 (1773)) of his wife, Elizabeth, he must have been a widower whe nhe
married her. In her Will she wrote: "my three daughtering laws, An nMatt-
ingly, Elizabeth Mattingly and Mary Mattingly." Thomas' first wife is not
known for certain, but is thought to have been Elizabeth Miles.
"Thomas Mattingly, son of Clement, was a witness to the Will of Raphael
Neale in 1771 (St. Mary's County, MD., Wills, Liber JJ #1, folio 43 2(6-13-
1771; 3-29-1788)).
"Both Thomas and his wife, Elizabeth wrote their Wills in April 17 73.
Elizabeth's Will was proven July 1, 1773 (St. Mary's County, MD., Wills,
Liber 39, folio 342 (1773)), and Thomas' on July 10, 1773 (St. Mary' sCounty,
MD., Wills, Liber 39, folio 350 (1773)). The religious faith of Thomas
appears in his Will: "I bequeath my soul to Almighty God who first gave it
me, hoping through the merits of my crucified Lord and Saviour Jesu sChrist
to obtain eternal life." He identified himself as "I, Thomas Mattingly, son
of Clement Mattingly." He named his father executor. He directed that his
debts be paid, and then made bequests to "my four children, Ann Mattingly,
Elizabeth Mattingly, Mary Mattingly and John Mattingly." (John and Mary
appear to have been the youngest.) A bequest was made to his wife but she
was not named. The residue of the personal estate was left to the children.
"Clement Mattingly, as executor for his son, Thomas, presented th eWill
and posted Bond September 20, 1773. (cite) Under date of June 30, 1773,
Edward Mattingly and Thos. McWilliams were securities for Clement i nthe
amount of 500 pounds sterling. The inventory of the estate of "Thomas
Mattingly, Jr." was presented for recording July 23, 1773. (citing St. Mary's
County, MD., Inventories, Liber 116, folio 216 (1773)). Appraisers were
Robert Thompson and Cyrus Vowles. Creditors were James Jordan (for John
Glassford Co.) and Catherine Jernigham. Given as kindred were Ann Mattingly
and Ruth Mattingly. The estate value was given as 274.5.10. Clement, exec-
utor, swore to the truth of the inventory March 20, 1773/4.
"Elizabeth (wife of Thomas of Clement) in her Will (Citing St. Mar y's
County, MD., Wills, Liber 39, folio 342 (1773)), made a bequest to "my
three daughtering laws, Ann Mattingly, Elizabeth Mattingly and Mary Matt-
ingly." Also remembered were Ann Mattingly, Ruthy Mattingly, Elizabeth
McWilliams and Mary McWilliams, whom she designated as "my sisterin glaws."
She also made bequests to her sisters, Lenderfin Wick(s), Elinor Miles,
Bitha Wildman and Becky Hill. Others named were Mr. George Slye, Elinor and
Ralph Neale, and Mrs. Elizabeth Neale, Snr. The residue was given t o"my
three daughtering laws, Ann, Elizabeth and Mary Mattingly." As did her
husband, she named Clement Mattingly, her father-in-law, as her executor."
"Of the children of Thomas (son of Clement) and Elizabeth (Miles?),
nothing is known of their daughter Ann. Elizabeth married Ethelber tCecil
and had a daughter, Elizabeth Maria, who married George Morgan. Elizabeth
died before 1800.
"Mary and John, the youngest of the four children of Thomas and Elizabeth,
had guardians appointed for them by the Court. They both appeared i nCourt
on the second Tuesday of August 1780, for this purpose. (cite) Mar ywas
placed under the guardianship of her aunt, Ruth Mattingly. Kenelm McWilliams
and Ann Mattingly were securities for Ruth in the amount of 10,000 pounds
current money. At the same time, John, Mary's brother, was given hi suncle,
Kenelm McWilliams, as guardian. Mary is known to have married Josep hRiswich
and they were the parents of a daughter Cecilia, who married Zachariah
Spalding.
"John, probably the youngest of the children of Thomas (son of Clement),
appeared in Court a second time in April, 1786, to have another guardian
appointed. His uncle, Kenelm McWilliams had died. John was given a s"above
the age of 14 years." He chose his aunt, Elizabeth McWilliams, for his new
guardian. (cite) Joseph Stone and James Heard were securities for his aunt
in the amount of 300 pounds current money. HIs new guardian made regular
reports of her guardianship. These were recorded (dates given).
"As previously noted, John, the grandson of Clement, received thre etracts
of land from his grandfather. The assessments records of St. Mary' sCounty
show that he paid for one of these, "Great St. Thomas" (150 acres), in 1793.
He was given as "John (of Thomas) Mattingly, Upper and Lower St. Clement's
Hundred." He was also assessed for "Pt. St. John's," a tract of 25 acres.
The following year he was asssessed for "Snow Hill," a tract of 100 acres.
He must have died in 1794 or 1795 since in 1796 and 1801, "Snow Hill "was
assessed to "John (of Thomas) Mattingly Heirs, St. Mary's County, MD., Upper
and Lower St. Clement's Hundred." [end at pg 31]

Pgs 13-14: "Thomas and Cezar Mattingly, the two sons of the immigran tThomas,
are the first recorded as having 300 acres due the six members of th efamily
at fifty acres each. The parcel of land was surveyed and patented t othem
in 1666 (citing Land Records, Liber EE, folio 469; Patents, Liber 9 ,folio
475. And Land Records Liber FF, folio 52; Patents, Liber 10, folio 4 5(1666).
(See Documents IV and V). The tract of land, to be known as "Mattingly's
Hope," was in Charles County. It was described as "lying in the woods on
the east side of the maine fresh runn of Portoback Creek and back side of
the land formerly laid out for John Cane and Ignatius Causine..." Th eProp-
erty was in Port Tobacco Hundred with a yearly rent of six shillings .The
patent for this tract testifies that the family had paid its own transpor-
tation to the Province and was, therefore, entitled to the 300 acres.
"More information is available about Thomas Mattingly II than abou this
brother Cezar. Both young men must have been good managers, since fourteen
years after receiving the patent to "Mattingly's Hope" in Charles County,
Thomas purchased two pieces of property back in St. Mary's County. Apparently
Cezar became possessor of the original "Mattingly's Hope" in Charle sCounty.
One of the parcels of land purchased by Thomas in St. Mary's County was known
as "Mount Misery" and contained 100 acres. It was surveyed for him May 28,
1680 (citing Land Records, Certificate Liber 20, folio 395 (1680)) (See Doc-
ument VI). The second tract, known also as "Mattingly's Hope," was surveyed
for Thomas July 7, 1680 (citing Land Records, Patents, Liber CB #2, folio 74
(1680) (See document VIII). Both pieces of property were on the wes tside
of St. Clement's Bay. They were patented September 28, 1680 (citin gIbid
and Patents Liber CB #2, folio 74 (1680) (See Documents VIII and IX).
"Thomas Mattingly II was a juror in the Provincial Court March 3 ,1684
(citing Provincial Court Judgments, Liber 3, DSA folio 102 (1684). He was
administrator for the estate of Robert Curtis in 1684 (citing St. Mary's Co.,
MD., Testamentary Proceedings, Liber 13, folio 197 (1684), and submitted an
account of the estate in 1686 (citing ibid folio 324 (1686). Also i n1686,
he was one of the appraisers for the estate of Thomas Wright. Later ,on
September 8, 1686, he was issued letters of discharge as administrator of the
estate of Mr. Curtis (citing St. Mary's Co., MD., Testamentary Procedures,
Liber 13, folio 405 (1686). In October, 1686, Thomas was one of th eappraisers
for the estate of Thomas Wright (citing Ibid, folio 421 (1686). In 1693 he
was summoned to Court in the case of James Martin vs. Edward Field and Edward
Cole (citing Provincial Court Judgments, St. Mary's Co., MD., Libe r 7#IL.,
folio 35, (1693). In 1702 he was in Court for the case of Slye vs Mason,
ex. (citing Provincial Court Judgments, St. Mary's Co., MD., Liber W T#4,
pp. 217a, 225, 231.
"In August, 1709, Thomas Mattingly and Robert Cole were sureties f or
Judith Clark, administratrix of Benjamin Clark (citing St. Mary's Co., Md.,
Testementary Procedures, Liber 21, folio 179 (1709). In 1713 there was an
appearance in Court of Thomas Mattingly, Jr. lessee of Richard Edele nvs
Margaret Mahaney (citing Provincial Court Judgments, Liber 10 #1, pp .306,
413 (1713). However, since this Thomas Mattingly is given as "Jr." it is
most likely that he was the son of Thomas Mattingly II, who died th enext
year (1714).
"Thomas Mattingly II signed his Will October 9, 1714 (citing St. Mary's
Co. Md., Wills, Liber 14, folio 222, (1714). It was proven by Adam Boyd,
Thomas Dillon and Richard Miller January 12, 1715. From this document it is
learned that his wife was Elizabeth. Named in the Will were nine children:
Thomas III, James, Charles, William, Luke, Ignatius, Elizabeth, Judith and
Ann.
"The will gives evidence of the religious faith of the testator . Itbe-
queathed "my soul to Almighty God that gave it, firmly and constantl ybeliev-
ing it thru the meritorious death and passion of my blessed Saviour Jesus
Christ, I shall receive full pardon and remission of my past sins..."
"Bequests in the Will included a tract of land, "Mount Misery," t ohis
son, Thomas. Since it is the first item in the will, it may be presumed that
Thomas was the eldest of the sons. Another son, James, received 13 0acres
out of the 200 acre tract on which the family lived (apparently "Mattingly's
Hope"). James also received a tract of 52 acres known as "Mattingly's Pur-
chase." A grandson, James Clark, son of Elizabeth Mattingly Clark, also re-
ceived a plantation of 70 acres which was described as an additiona lpart of
the family "dwelling plantation" (i.e. of the tract bequeathed to James).
The daughters, Elizabeth Clark and Judith Parker, received bequests.
"It is not certain which of the children were of age at the time t hewill
was written. Since two of the daughters were given as married (Elizabeth
Clark and Judith Parker), it is presumed they were of age. Thomas must have
been of age and probably married; he was living on the tract known a s"Mount
Misery." It would seem that James also was of age. The testator, however,
wrote in his will: It is my will and desire that my male children b eof age
at eighteen years, and my daughters at sixteen."
"The residue of the estate was to be equally divided between his w ifewho
is named executrix, and the remaining five children who had receive dno legacy,
Charles, William, Luke, Ignatius and Ann."

mother would reject the terms of the Will and claim her third part, then he
and his brother, James, were to be overseers of the Will. Thomas wa sappar-
ently the eldest of the sons. He received the tract "Mount Misery" of 100
acres, on which he was then living, this indicating that he was probably
married at the time of his father's death. Besides the tract of land, he
also received "all and singular the appurtenances thereunto belongin gto-

(Apr 22, 1724)). Later that year, with Clement Gardner, he submitte dthe
appraisal of the estate of Thomas Melton (citing St. Mary's Co., MD. ,Inven-
tories, Liber 10, folio 165 (Sep 21, 1724)). On November 19, 1724, he and
William Hayden were witnesses and sureties in the settlement of the estate
of Edward Feld (citing St. Mary's Co., MD., Testamentary Procedures ,Liber
27, folio 111 (Nov 19, 1724)). With Richard Cooper he was surety i nMarch
1728/29 for Juliana Taylor, administratrix of the estate of Vincent Taylor
(citing ibid Liber 28, folio 356 (Mar 18, 1728/29)).
"Thomas Mattingly was one of the appraisers for the estate of hi ssister,
Mrs. Elizabeth Clarke, and submitted the appraisal for recording Feb .25,
1735/36 (citing St. Mary's Co., MD., Inventories, Liber 21, folio 29 6(Feb.
25, 1735/36)). On March 7, 1737, he and George Knott were sureties for Ann
Knott, widow and executrix for the estate of Thomas Knott (citing St .Mary's
Co., Md., Testamentary Procedures, Liber 30, folio 406 (Mar 7, 1737)). He
was among the borrowers of books from the Old Newtown Library in 174 0("Chron-
icles of St. Mary's," Bef. 1954, p. 5). Thomas was also one of the sureties
in 1741 for his sister, Ann Knott, widow of William Knott (citing St .Mary's
Co., Md., Accounts, Liber 18, folio 273 (1741)). An indenture was signed
June 30, 1742 by Thomas Mattingly and Peter Gough, in which Thomas agreed
to buy "Audley's End," a tract of 190 acres in St. Mary's County. Thomas
paid for the tract Sept. 22, 1742 (citing Deeds, Adams Collection, Hall of
Records, Annapolis, MD., M. 522 (1742)). He was a witness to the Will of
William Herbert in 1749 (citing St. Mary's Co., MD., Wills, Liber 27 ,folio
245 (Aug 10, 1749; Apr 3, 1750)).
"The Debt Books of St. Mary's County reveal that Thomas Mattingl y IIIpaid
quit rents on two parcels of land beginning in 1753, and continuing until his
death in 1774 (citing St. Mary's Co., MD, Debt Books 1753-1774). They were
"Mount Misery," a tract of 100 acres, and "Part St. Thomas," a trac tof 150
acres. He also paid rent beginning in 1759 for "St. John Als Mattingly Lane"
("St. John's alias Mattingly Lane), a tract of 25 acres.
"That Thomas Mattingly III was married first to Elizabeth Warren i sevident
from the Will of Thomas Warren (citing St. Mary's Co., MD., Wills, Liber 24,
folio 164 (Mar 13, 1744/5; Jun 4, 1745)). Leonard and Edward Mattingly, both
sons of Thomas III, were named by Thomas Warren as grandsons and heirs of
his daughter, Elizabeth Mattingly. Elizabeth died sometime before 1717 when
Thomas Mattingly's wife was Ruth Cole, daughter of Edward Cole. Thi sis
evident from the latter's will (citing St. Mary's Co., Md., Wills, Liber 14,
folio 644 (Apr 16, 1717; Dec 20, 1717)). Elizabeth Cole, executrix of her
husband, Edward, in rendering the account of his estate, mentions payment made
to Thomas Mattingly "....in part of his filial portion..." (citing St. Mary's
Co., MD., Wills, Liber HH #1, folio 417 (Aug 16, 1720)).
"Ruth Cole was the daughter of Edward Cole (1657-1717), who is probably
the son of robert Cole who died in 1663. The Hon. Edward Cole, Gent.,
married Elizabeth Slye (c.1669-1722), daughter of Capt. Robert Slye (b. in
England 1615) and Susannah Gerrard, daughter of Thomas Gerrard and Susannah
Snow (citing Register of Maryland's Heraldic Families, 1634-1935; v.1, p.
156).
"Thomas Mattingly III was about eighty years of age at the time o fhis
death. His son Thomas IV, was already dead, as was his daughter Elizabeth.
"Thomas wrote his Will March 11, 1774 (citing St. Mary's Co., Md. ,Wills,
Liber 40, folio 99 (1774)). It was proven September 10, 1774. Witnesses to
the will were Joshua Mills, -lley Mills and Teresa Mills. His wife was still
living, but was not named. Leonard was named first in the Will, apparentley
confirming that he was the eldest of the sons.
"Thomas had made "deeds of gift" to his children July 7, 1745. Th ese
gifts are not known. However, a "little slipe of land," Called "Mattingly's
Lane," which was intended for his son, John Baptist, but bought fro mhim by
his brother, Edward, was determined by thier father to be the property of Ed-
ward. The Will also indicated that Edward had made other purchases of the
estate from his brothers. The residue was to be divided "among my several
children and grandchildren according to the true intent and meaning of my
deed of gift aforesaid." The "deed of gift" has not been found. I twould
reveal much. Executors named in the will were two sons, Edward and Clement.
"Children whose names are found in the Will of Thomas Mattingly II Iwere
Leonard, John Baptist, Edward and Clement. Other records tell of a son, Thom-
as IV, who died in 1756. His father, Thomas III, was the administrator of his
estate. The son, Edward, in his will (1777) tells of another son, James
(citing St. Mary's Co., MD., Wills, Liber JJ #1, folio 38 (1776)). Edward
made a bequest to "my niece and goddaughter Ann Millard." She was the daugh-
ter of Mary Mattingly who had married Richard Millard. Therefore, the child-
ren of Thomas III not named in his will were Thomas IV, James, Nanc yand Eliz-
abeth."

!NOTES:
THE MATTINGLY FAMILY OF EARLY AMERICA by Herman E. Mattingly, 1975 ,p. 35:
"Thomas Mattingly IV was the son of Thomas Mattingly III and Rut hCole. He
died in 1756 and, therefore, was not named in his father's will of 1774.
"On August 4, 1756, James Heard and Raphael Neale submitted in Cou rta
long inventory (cite) of the estate of Thomas Mattingly, late of St .Mary's
County. Vincent Taylor and John Baptist Mattingly signed the inventory.
Along with Philip Key and --?-- Lock, they were listed as creditors .Thomas
Mattingly, evidently the father of Thomas IV, swore to the truth of the
inventory March 1, 1757.
"Thomas Mattingly posted bond as administrator of "Thomas Mattingl y,Jr."
on August 4, 1756. John Reeder and Clement Spaulding of St. Mary's County
were his sureties in the amount of 250 pounds sterling (cite). Returns
from St. Mary's County included the inventory of Thomas Mattingly with a
value of 177.15.1/2 (cite). Again on November 16, 1757, returns fro mSt.
Mary's County, included "Thomas Mattingly, Junr., his account by Thomas
Mattingly, his administrator." (cite)
"By virtue of a commission granted him July 23, 1757, Thomas Mattingly's
father submitted an account of his son's estate September 20, 1757. (cite)
Names which appear in the inventory are Edward Mattingly, Philip Key ,Will-
iam McWilliams and James Mattingly. On August 12, 1758, the accoun tof
"Thomas Mattingly, Jr.....by Thomas Mattingly, senior, his administrator,"
was ordered filed (cite).
"The children of Thomas Mattingly IV are learned from the recordin gof
balances and final distribution books on July 4, 1759 (cite). Afte rallowed
disbursements the value of the estate was given as 126.2.10 1/2. I twas
ordered divided equally among Dorothy Mattingly, Mary Mattingly, Elizabeth
Mattingly, Sarah Mattingly, Edward Mattingly and Thomas Mattingly. No widow
was named.
"The account submitted on the same date, July 4, 1759 (cite), gav ethe
ages of the children. Dorothy and Mary were listed as "at full age. "Eliz-
abeth was "about 14 yr. old"; Sarah, "about 12 yr. old." Edward wa snamed
next in order, but his age is not discernible. Thomas was given as "about
3---?." The record is peculiar in that it states that "Thomas, son ,came
making further accounts of father...."
"Of the children of Thomas Mattingly IV we know little except fo rEdward
and Thomas. Edward is most likely the one who served so gallantly i nthe
Revolutionary War. (See section on Military Records.) If so, he die dSep-
tember 5, 1821, in the 69th year of his age (cite). His age would fit very
well with the above accounting of the ages of Thomas' children.
"This Edward is most likely the Edward Mattingly, Jr., who with hi suncle,
Edward Mattingly, and Thomas Spalding, were witnesses to the Will o fhis
cousin, Dorothy Mattingly, October 16, 1774 (cite). Edward, Jr. would have
been 22 years of age at the time.
"From the will (St. Mary's County, MD., Wills, Liber JJ #1, foli o 195
(1779) of Thomas V. written May 1, 1779, it is learned that his sister, Mary,
married _____ Knott. He left Mary all his estate and made her sole executrix.
He gave her "all my estate given me from my grandfather Mattingly, and my
uncle Edward Mattingly's estate." (Edward died in 1778, one year before.)
Apparently, Thomas V. had not married; no wife or children were named."

!NOTES:
See THE MATTINGLY FAMILY OF EARLY AMERICA by Herman E. Mattingly ,(1975);
p. 51: "William Mattingly was probably not of age at the time his father,
Thomas Mattingly II, wrote his will in 1714 (citing St. Mary's Co., Md.,
Wills, Liber 14, folio 222 (1714)). According to the terms of his father's
will, parcels of property were devised to his older brothers, Thoma sand
James, and to a grandson, James Clark. Personalty was bequeathed t otwo
daughters, Elizabeth Clark and Judity Parker. William received fou rthousand
pounds of tobacco, and was to receive an equal portion of the residu eof the
estate with brothers Charles, Luke and Ignatius, and a sister Ann.
"Little is known of this William Mattingly. He was, however, on t heDebt
Books of St. Mary's County for a parcel of land known as "Clever," containing
155 acres (citing Debt Books, St. Mary's County, Md., 1753-1774)). The record
shows that he had the tract from 1754 to 1758; not in 1759, 1768 or 1771. He
also had "Suttles Rest" ("Part Suttles Range," 1753-1758; "Suttles Rest,"
1767-1774) (citing ibid). Though William died in 1771, it is curiou sto note
that a William Mattingly was on the Debt Books for "Suttles Rest" until 1774.
This must have been another William Mattingly, not the son of this William,
since he alludes to his "four children" in his will and names four daughters.
"In a separate Debt Book entry William was listed (citing St. Mary 'sCo.,
Md., Debt Books, 1754-1766)) for "Part Scuttle als Rest" (Suttle alias Rest",
"Suttles Range alias Rest"). The record extends from 1754 to 1766.
"William's will (citing ibid Wills, Liber 38, folio 599, (1771)) , was
written November 28, 1771, indicates that he possessed property, bu tit was
not named. The property was to be sold to the highest bidder and th eproceeds
divided "among my four children." His "four children" were all daughters,
two of them married. The family lived in St. Mary's County where th ewill was
proven December 13, 1771. Witnessing the writing of the document were a
nephew, Edward Mattingly, William Wathen and Henry Mattingly, whose relation-
ship is not known. No wife was named in the will.
"William refers to his "daughters Wathing and Saxton," and to hi s"two
daughters who are unmarried, Polley and Dolly Mattingly." Leonard Wathen
and Robert Saxton, "my two sons-in-law," were named executors. Robert Saxton
and Elizabeth Wathen were witnesses to the Will of Nicholas Drury i n1789
(citing ibid Wills, Liber JJ #1, folio 481, May 22, 1789). It is concluded
that the daughter who married Leonard Wathen was named Elizabeth, an dthat
the one who married Robert Saxton was named Ann. Robert Saxton wa s awitness
to the Will in 1789 (citing ibid Wills, Liber JJ #1, folio 470 (1789)) of
Ignatius Mattingly, brother of his father-in-law, William.
"The inventory of William Mattingly's estate was presented for recording
by Leonard Wathen, executor, July 21, 1772 (citing ibid Inventories ,Liber
109, folio 355 (1772). Creditors named were James Roach, John Bruv e(Brew-
er?), Luke Mattingly and Igna. Mattingly. On October 8, 1772, bond was order-
ed filed and other proceedings recorded (citing ibid Testamentary Proceedings,
Liber 44, folio 581 (1772)). On December 30, 1772, the will of William Matt-
ingly and testamentary bond were exhibited in court by Leonard Wathen, exec-
utor (citing ibid Testamentary Proceedings, Liber 44, folio 382 (1772)). His
surety in the amount of 200 pounds sterling was Edward Mattingly.
"The commission of Leonard Wathen as executor for William Mattingl ywas
recorded July 16, 1773 (citing ibid Liber 45, folio 155 (1773)). O nOctober
10, 1773, Mr. Wathen presented the final balnace and distribution o fthe
estate (citing ibid Balances and Final Distributions, Liber 6, foli o277
(1773)). Edward Mattingly was surety. His "daughters Wathen and Saxton"
each received a "young Heifer." Polly and Dolly Mattingly were give nthe
residue. The final report was also recorded under Accounts in St. Mary's
County by Mr. Wathen on the same date (citing ibid Accounts, Liber 69, folio
208 (1773)). It reported payments made (among others) to James Mattingly,
Leonard Mattingly, and Ignatius Mattingly.
"Robert Saxton in his will (citing ibid Wills, Liber JJ #3, foli o 160
(June 2, 1803)) of 1803, gives his wife as Ann, and names his children
Bennet, Raphael, William, John, Joseph, eleanor (m. Hanson Wakelin) ,Eliz-
abeth and Ann.
"It is curious to note that Father James Walton, S.J., in his Diar y(1775-
1784) records the baptism on January 1, 1772, of Eleanor Saxon, daughter of
Robert and Elizabeth (citing Diary of Father James Walton, S.J., (1775-1784),
Provincial Archives, Jesuit Fathers, Baltimore). He also records th ebaptism
on November 1, 1773, of Zachariah Saxton, son of Robert and Elizabeth. Al-
though Robert Saxton names Eleanor among his daughters in his will, there
is no mention of a son, Zachariah. And his wife was named Ann. AnotherRobert Saxton?"

"Discovery" (38 3/4 acres); and "Pt. Linstead" (35 acres).

"Zachariah served under Captain Burnham in Colonel William Smallwood'sMaryland Regiment, organized before the Declaration of Independence .(Citing Unpublished Revolutionary War Records of Maryland by MargaretHodges , Vol. II, p. 12.) Captain Joseph Ford listed Zachariah forservices rendered the troops in his report of 1780. (Citing MilitaryRecords, Box 3, folder 17, Hall of Records, Annapolis.) Zachariah wasalso enrolled in the Militia of St . Mary's County.

"On April 20, 1787, Zachariah petitioned the court for a survey offour acres of land adjoining a tract called "Shirtcliffe". (Citing St.Mar y's Co., MD., Land Records, Liber IC ##, folio 375 (1787)). Thepetition was granted and the survey ordered. He was listed in theCensus of St. Mary's County in 1790. The family was made up of twomales over 16 years of age; two females and four slaves. TwoZachariah Mattinglys were among the Easter Communicants at St.Inigoes, St. Mary's County, in 1794 according to Father Walton'srecords. There were also two Zachariah Mattinglys in St. Mary'sCounty (and one in Charles County) according to the Federal census of1800. One of the two in St. Mary's County had a family of three withthree slaves; the other, a family of six with twenty slaves.

"Zachariah Mattingly and Eleanore Duggans were sponsors August 6,1778, at the baptism of John Shercliff, son of Thomas and Elizabeth.(Citing Father Walton's Diary). Zachariah married Ann Panny SpaldingJanuary 20, 1798. She was the sister of Thomas Spalding, husband ofElizabeth Mattingly, sister of Zachariah. Ann Panny Spalding hadpreviously married (January 20, 1771) Raphael Ford, and secondly,Joshua Millard. No children were born of the first two unions.

On June 23, 1996, I received from Donna K. Mullin, 227 Narcissus Dr.,Indianapolis, IN, a photocopy of a death record that was published ina Taylorsville, KY, paper on the death of Malinda (May) Stone:

"DIED - - at her home near Taylorsville, March 10, 1896, Mrs. MalindaStone in the 78th year of her age.
"She died as she had lived, a true Christian, she had been aconsistant member of the Presbyterian church for many years."
"Ah! Then thou are come, our sister, friend,
Life's cares and toils are o'er.
In Heaven thou has a brighter home
Care and suffering there no more;
Earth's charms are lost to thee.
Mid splendor of the heavenly courts.
Many loved ones there thou wilt see.
Around the throne of God above,
Yes, the dear ones gone will welcome thee."

"Malinda May Stone born 1818, died 1896, daughter of Stephen May, wifeof Eli D. Stone."
