He hadbeen born on August 13, 1835, and was a son of Carson and Cassa(Carlton) Patterson. He served as a captain in the Confederate StatesArmy during the Civil War. He died on June 20, 1893, and was buriedin the Spring Hill Cemetery located at the Spring Hill Baptist Churchnear Eaton, Tennessee. Polina survived him by forty years, dying onJuly 13, 1933, in Gibson County. She, too, was buried in the SpringHill Cemetery. She and Robert had nine children: Mattie, Jesse,Bertie, Russell, Minnie, Gordie, Ruby, Mary, and Irene."

In addition to Alethaire (Althea or Allie) being Teresa (Payne)Jenkins daughter-in-law, we must recognise that they are related toeach other by virture of two common ancestors. They are first cousinsonce removed by virtue of their common ancestor, Basil Payne (1102).Basil is Teresa's grandfather and is Alethair's great-grandfather.They are also related through William Spalding (1128) as third cousinsonce removed. William is Teresa's maternal 2g grandfather and he isAlethair's maternal 3g grandfather.
Presumably she was named after her great-grandmother Alethaire Abell(1144) Spalding and her great-aunt Alethaire Spalding, (1155) sisterof her grandfather, William (1156).
In an article on the life of Teresa Payne's son Dr. John T. SpaldingJenkins (64) in HISTORY OF UNION COUNTY, KY, op.cit. at pp 238-240, itstates "On the tenth day of May, 1864, he married Miss Alethea AnnPayne, daughter of John Payne of Union County (Kentucky)." Again onpage 642 it states "The physician next in succession to R. H. C. Rhea,Sr. was Dr. J. T. Jenkins, from Louisville, his wife being AlliePayne, daughter of John Payne and Jane Spalding." From these weconclude that Alethea Ann Payne is the daughter of this John Payne andJane Catherine Spalding.

Payne, Basil; Free white males 16 & over, 2: under 16, 5; free females3; slaves, 1. (This census establishes a family in 1790 of 6 malechildren and 2 females. The will mentions 5 male children and onefemale: Thomas, Joseph, Basil, Jr., John, Richard, and MargaretEdwards.) The one male child and one female not mentioned in thewill probably died before Basil. Also mentioned in the same censuswere John B. Payne with one male and three females and James Paynewith 2 males, 3 females and one slave. We know that John "Jackie"Payne was born about 1778 and married Catherine Smith in October 1798so the John B. Payne in the census of 1790 was not him.

"I Basil Payne of Saint Mary's County being aged and infirm but ofSound and disposing mind , memory and understanding do make andpublish this my Last Will and Testament in manner and form following,that is to say, first I bequeath my Soul to Almighty God who gave it,and my body to Earth in sure and certain hope of a happy resurrection,and after my just debts, which are few, are paid, I bequeath asfollows:

According to THOMAS JENKINS OF MARYLAND, 1670, by Edward FelixJenkins,
O.S.A., at pp 39 & 62, Jane Spalding (1220) was a first cousin ofThomas Spalding, Jr. (1208) who was the father of Catherine Spalding(1358 ) and the grandfather of Teresa Payne (1074). Jane married aMr. Lowe and had a daughter, name unknown, who married the abovewitness to Basil Payne's Will, James H. Wathen. Their children arenamed on page 62. Catherine Spalding Payne and the wife of JamesHanson Wathen were great-grandchildren of William Spalding (1128) andAnn Jenkins Spalding (100).
MISCELLANEOUS:
In the search for Basil's family, we find in Saint Mary's County WillBook TA 1, pg 217, reference to the last will of Thomas Payne dated1747. He could be of the proper age to be Basil's grandfather."Spouse: Elizabeth; Children: Joseph, Thomas, John, Diana, Elizabeth,Isaac, Mary."
On pg 862, MARYLAND WILL BOOK 31, Part I, it states "John Payn of St.Michael's Hundred in St. Mary's County. To my mother ElizabethHarrison (I leave) my estate. I appoint William Harrison and mymother, Executors. 1/20/1763. Witnesses: John Langley, George Smootand Thomas Crawley . Will probated 2/8/1763. Is this latter John"Payn" the same John who was a son of Thomas who died in 1747? It ispossible that Elizabeth Payne married William Harrison after the deathof Thomas. John died apparently without leaving children. Thatleaves Joseph or Thomas as possible fathers of Basil who wouldprobably have been born in the 1730s or 40s. Notice that Basil'soldest son and primary beneficiary was named Thomas, possibly afterBasil's "father" Thomas.
A Joseph Payne married a Mary Gibbs on 1 June, 1730 in Ann ArundelCounty, St. Ann's Parish, Vol. 1 of records. This is the rankest ofspeculation i.e. Thomas b.ca. 1670 m Elizabeth ca.1700; (Joseph b.ca.1700; m. Mary Gibbs 1731); Thomas Jr., b.ca. 1700, married ???;Basil b.ca . 1735, d.1811 age 76. Since Joseph married a Mary Gibbs,Thomas is the most likely candidate as Basil's father. Worthinvestigating . Check records of Ann Arundel County (see above forJoseph's marriage) or Charles County (see below for Basil witnessing awill in 1768).
In MARYLAND EARLY SETTLERS, Lib. 15, Part 1, Sec. 144, pg 409: RICHARDPAYNE (PANE) rights proved. (Is this rights to acreage on hisimmigration?) Who is this Richard and when did this occur?
ANALYSIS:
Basil Payne witnessed the Last Will of Alexander Smith Hawkins dated 7Sep 1768. Alexander died in Charles County, MD. Probate commenced 16Jan 1769. (Folio 36, Page 689). This is the earliest record of BasilPayne who could have been about 35 years old. The first mention ofthe Basil Payne family in St. Mary's County is found (see above)Herman Mattingly's book where Basil and Margaret sponsored JohnMattingly, son of William and Mary Mattingly, on November 24, 1776.See below for a record involving Basil Payne in Charles County in1772.
There are several Payne subscribers to the Oath's of Allegience of St.Mary's County in 1778 but no Basil and no Joseph. There is a Richardand a John but no proof that they are Basil's sons. The next mentionof Basil Payne is found in Father O'Rourke's book listing the Militiaof St. Mary's County in 1794 which includes Basil Joseph, his son, anda James and John, as members. The next mention of a Payne in St.Mary's County is the marriage of Richard to Catherine in 1802, and thelast is Basil's probate in 1811. It is notable that no births ofthe children of Basil and Catherine can be found in the church recordspreserved in Father O'Rourke's book . Nor are there records ofmarriages which mention Basil or Margaret.
It is apparent that the family must have come to St. Mary's countyfrom another location before 1776. Charles County is possible. SeeMARYLAND GENEALOGICAL SOCIETY BULLETIN, Volume 25, No. 2, Spring 1984,Charles County Maryland Probate Records, Inventories, Part II,1753-1779, item 516: "William Payn - 22 Jan 1772 - no kindred inMaryland - Basil Payne Admr."
Also found relating to Charles County is an entry from the MARYLANDGENEALOGICAL SOCIETY BULLETIN, Volume 25, No. 1, Winter, 1985 whichcontains records of the Charles County Deeds 1743-1744, Liber 2 atpage 61 we find the following entry:
"Ignatius Mitchell of Charles County, 27 Feb 1743. 19 Jan 1743, JohnPayn of Charles County, planter & wife Eleanor Payn to IgnatiusMitchell of Charles County, Joynor. For labor of 2 slaves duringlives, a table to be delivered at next Christmas, "Rally" 200 acres,part of "Payns Addition" 140 acres & part "Payns Second Addition" 216acres. Witness: Robert Hanson & Wm. Eilbeck. Memorandum to witresidue unsold to Wm MacPherson."
Thomas Payne died 18 Jan 1747 in St. Mary's Co. Will Book 25, p277 .Wife Elizabeth, children Mary, Isaac, Joseph, John, Diana andElizabeth. ( See above).

FHL985186 Genealogical Cards: These cards are not authority but a cardon Basil Payne Jr. reveals that he was married (1st) to (Sarah?)Elizabeth Mattingly and (2nd) Polly Mattingly (niece of ElizabethMattingly) . Elizabeth was born in 1774 in St. Mary's Co., MD. anddied in Marion Co., KY. They had several children of which two arenamed Charles Henry Payne aka Harry, and William Payne. PollyMattingly was the daughter of John Mattingly and Mary (Polly) Fenwick. They apparently had no issue.

THOMAS JEFFERSON SHOEMAKER, M.D. Union County, was born in Spence rCounty, Ky., June 5 1837, a son of John and Ruth (Offutt) Shoemaker ,and is of German-English extraction. His father was born in Pittsburg, Penn., in 1787, and his mother, Ruth C. Offutt, in the State of Maryland in 1801. The ancestors of Dr. Shoemaker came to America fro mGermany. His father's death took place in spencer County, Ky., i n1852. the boyhood of our subject was spent in attending the commo nschools and St. Mary's College, in Marion County, after which he taught school for some years, and was one of the most successful teachers of his day. In 1862 he began the study of medicine in the offic eof Drs. R. D. Spaulding and William A. Jones. He attended the Medical Department of the University of Louisville, 1863-64, and in 186 5he received a diploma from the Kentucky School of Medicine, and on e(a diploma) from the University of Louisville, Ky., in 1868. In 18 65he began the practice of his profession at Morganfield, and here h assince continued. He was married June 4, 1866, to Miss Frances E .Payne, of Waverly, Ky., daughter of John and Jane Payne. Of eleve nchildren born to this union, only six are living. Dr. Shoemaker i s aDemocrat and a member of the Catholic Church; through his untirin genergy he has made life a success.

"JOHN SPALDING PAYNE, farmer of Waverly Precinct, is the son of Johnand Jane Catherine (Spalding) Payne. His father was born on thepresent home farm of our subject in 1814; he married there in 1838,and died in Waverly Precinct in August, 1881; he was interested in theCivil War, and went South several times presumably on business for theConfederacy. He was taken to Louisville once on account of hissympathy with the Confederacy, and also to Uniontown. The mother ofour subject was also born in Union County in 1821, and is still livingin Uniontown. Mr. Paynes' paternal grandfather John Payne, who openedthe farm at Waverly, was born in St. Mary's County, MD. in 1806(**Should be 1776, see comment below); came to Union County in 1811,and died at T. B. Mills' house in 1858.
"Our subject's maternal grandfather, William F. Spalding, a farmer ofUniontown Precinct, was born in Marion County in 1795; married a MissWathen there, and coming to Union at a very early day, died here in1870. Our subject was born where he now lives, on January 17, 1845.He received some 10 years training in the schools of Waverly Precinct,and then attended Cecilian College for two years. He was marriedfirst in 1875, but his wife died, and in October, 1881, he was marriedto Matilda Cruz, the daughter of John B. and Minta (Wathen) Cruz, whocame from one of the oldest families in the county. Her grandfathers,Peter Cruz and Frank Wathen are both dead. Her grandfather Wathenmarried a Miss Clements. She was born in 1859. Emma and John Hudsonare the children who have been born of this union.

"KatieGill" was another of his fast colts, and "Eddie Payne" sold for $300when he was but two years old. There is a Joseph Pain enumerated in the 1810 census for NelsonCounty,Kentucky, dist. 35 as 30010-10010-02 indicating that thisJoseph is between 26 and 45 years of age, his wife is the same, theyhave three sons under 10 and one daughter under 10. They have 2slaves. It is not know whether this is Robert's brother. Robert wasmarried to Catherine Spaulding in Maryland in 1802 and came to NelsonCounty, Kentucky, not long thereafter.

In an article on the life of Teresa Payne's son Dr. John T. SpaldingJenkins (64) in HISTORY OF UNION COUNTY, KY, op.cit. at pp 238-240, itstates "On the tenth day of May, 1864, he married Miss Alethea AnnPayne, daughter of John Payne of Union County (Kentucky)." Again onpage 642 it states "The physician next in succession to R. H. C. Rhea,Sr. was Dr. J. T. Jenkins, from Louisville, his wife being AlliePayne, daughter of John Payne and Jane Spalding." From these weconclude that Alethea Ann Payne is the daughter of this John Payne andJane Catherine Spalding.
In TOM JENKINS OF MD on pg 76, in an article on the children of JohnR. Jenkins and Teresa (Payne) Jenkins, specifically their son George,it states that he "married Henrietta Payne, born 1846; died 1906;sister of Alethea Payne who married his brother (John T.)." Thus itappears likely that Alethea and Henrietta were daughters of John andJane Catherine (Spalding) Payne (1070) and sisters of John SpaldingPayne (1072).

SUMMARY:
We can be fairly sure that Richard Payne and Catherine Spalding arethe parents of Teresa Payne because of the record of Teresa's marriageto John Jenkins. The bond was signed by her brother Hillary. Inreading the above cited sources, we learned that many Paynes migratedto Nelson County,
KY., from St. Mary's County, Maryland. A check of those recordsrevealed the marriage of Richard and Catherine in that county on 22May, 1802 . We are speculating that he is the son of Basil Payne whosewill was filed January 29, 1811 and which mentions a son Richard.
The will of Basil Payne mentions a daughter, Margaret Edwards. Shewas married to Ignatius Edwards on 8 February, 1805, three years afterRichard and Catherine, at St. Francis Xavier Catholic Church in St.Mary's County. Check all church records for Richard's marriage.

RESEARCH:
Under Hillary Payne, note shows deeds to him from William Payne in1832 and from Alexander Payne in 1856. They could both be related toHillary, possibly uncles. They are not in Basil's will however. Ilearned of the marriage of a Basil Payne and Sarah Mattingly inWashington Co., VA. , on or April 21, 1797. There is also a JamesPayne, aged 45 in the 1870 census of Washington Co., VA. Thus Jameswould have been born in 1835.
