NOTES:
See History of St. Mary's County, Maryland, 1634-1990, pg. 103 for alist of the people who followed Clement Gardiner and Henrietta BooneGardiner to the Cox Creek Settlement near Bardstown, Nelson County,Kentucky, before 1800. One of the names in the list was John Payne. Hehad been married in St. Mary's County in 1798. We also know that hisbrother Richard and his wife Catherine had married later in 1802 andsettled in Nelson County, Kentucky where several of their children wereborn.
See THE HISTORY OF UNION COUNTY, KY., 1886 published in EvansvilleIN. by the Courier Co, Printers, Binders and Engravers, FHL 976.9885H2h,at page 628:
"Due east from our point of view, was another settlement madesometime in the eighteenth century, by John (Jacky) Payne, his wife beingKatie Smith; they were Roman Catholics, from St. Mary's County, Maryland;his direct descendants are still there. His grandson John S. Payne, whomarried Matilda Cruz, daughter of John B. Cruz and Mintie Wathen, ownsthe old homestead, and is rearing (1886) the fourth generation on thesame soil and with all the modern improvements on the plow share, scytheand cycle, commanding mother earth to give forth abundant fruits to hishusbandry. Towards the northeast were two settlements, one by ThomasThompson, which his son inherited, and is now owned by his grandsons,John and Thomas Thompson; the other by Nathaniel Floyd. His wife is aMiss Jeffers. They were from Maryland, and settled where E. C. Willettnow lives."
"A few years later between the two, settled Timothy B. Mills, whomarried a daughter of Jacky Payne and Katie Smith. The place he settledbought by the above-named Thompsons, and is now owned by them."
"See also at pps 654-5 on the life of his grandson, John SpaldingPayne, "Mr. Payne's paternal grandfather, John Payne, who opened the farmat Waverly (eastern Union County, Kentucky near the border with HendersonCounty), was born in St. Mary's County, Maryland, in 1806; (JS: Thisdate must be incorrect) came to Union County in 1811 and died at T. In April, 2000, I received information concerning Walter Payne fromThomas W. Hancock (2ggrandson of Jackie Payne) , of John P. This article is on his son John Spalding Payne, but makes thefollowing statements about his father John Payne: "John Spalding Payne, farmer of Waverly Precinct, is the son of John and Jane Catherine(Spalding) Payne. His father was born on the present home farm of oursubject in 1814; he married there in 1838, and died in Waverly Precinct(near Henderson County) in August, 1881. He was interested in the CivilWar, and went South several times, presumably on business for theConfederacy. He was taken to Louisville once on account of his sympathywith the Confederacy, and also to Uniontown. The mother of our subjectwas also born in Union County in 1821, and is still living in Uniontown."

See UNION COUNTY, KENTUCKY MARRIAGE BOOKS 1811-1883, FHL 976.988 5V28h at 1837: PAYNE, JOHN - JANE C. SPAULDING, February 10, 1837
SPECULATION:
In an article on the life of Teresa Payne's son Dr. John T. SpaldingJenkins (64) in HISTORY OF UNION COUNTY, KY, op.cit. at pp 238-240, itstates "On the tenth day of May, 1864, he married Miss Alethea Ann Payne, daughter of John Payne of Union County (Kentucky)." Again on page 642 itstates "The physician next in succession to R. H. C. Rhea, Sr. was Dr. J.T. Jenkins, from Louisville, his wife being Allie Payne, daughter of JohnPayne and Jane Spalding." From these we conclude that Alethea Ann Payneis the daughter of this John Payne and Jane Catherine Spalding.
In TOM JENKINS OF MD on pg 76, in an article on the children of JohnR. Jenkins and Teresa (Payne) Jenkins, specifically their son George, itstates that he "married Henrietta Payne, born 1846; died 1906; sister ofAlethea Payne who married his brother (John T.)." Thus it appears likelythat Alethea and Henrietta were daughters of John and Jane Catherine(Spalding) Payne (1070) and sisters of John Spalding Payne (1072).
If the assumptions about John (Jacky) Payne being a son of Basil Payne
are correct, we have:
Basil Payne

"JOHN SPALDING PAYNE, farmer of Waverly Precinct, is the son of Johnand Jane Catherine (Spalding) Payne. His father was born on the presenthome farm of our subject in 1814; he married there in 1838, and died inWaverly Precinct in August, 1881; he was interested in the Civil War, andwent South several times presumably on business for the Confederacy. Hewas taken to Louisville once on account of his sympathy with theConfederacy, and also to Uniontown. The mother of our subject was alsoborn in Union County in 1821, and is still living in Uniontown. Mr.Paynes' paternal grandfather John Payne, who opened the farm at Waverly, was born in St. Mary's County, MD. in 1806 (**Should be 1776, see commentbelow); came to Union County in 1811, and died at T. B. Mills' house in1858.
"Our subject's maternal grandfather, William F. Spalding, a farmer ofUniontown Precinct, was born in Marion County in 1795; married a MissWathen there, and coming to Union at a very early day, died here in1870. Our subject was born where he now lives, on January 17, 1845. Hereceived some 10 years training in the schools of Waverly Precinct, andthen attended Cecilian College for two years. He was married first in1875, but his wife died, and in October, 1881, he was married to MatildaCruz, the daughter of John B. and Minta (Wathen) Cruz, who came from oneof the oldest families in the county. Her grandfathers, Peter Cruz andFrank Wathen are both dead. Her grandfather Wathen married a MissClements. She was born in 1859. Emma and John Hudson are the childrenwho have been born of this union.
"Our subject has travelled extensively in Tennessee, Arkansas,Mississippi, Missouri, Ohio, Indiana and Louisiana, but is still livingon the old home farm where he cares for one hundred eighty acres, andraises some of the finest horses in this part of Kentucky. His colt,"Harry Cruz," made 1 1/16 miles in the fastest time. "Katie Gill" wasanother of his fast colts, and "Eddie Payne" sold for $300 when he wasbut two years old. Mr. Payne now owns "Lillie B," a very promising fillythat is only a year old (January 1886), and she is entered for theCovington races next year. Mr. Payne's residence is a substantial frame, romantically situated upon a hill that overlooks the long town of Waverlyand the track of the Ohio Valley Railroad. It was erected in 1878. Inpolitics, Mr. Payne is a Democrat . In religion he is a Catholic. He isa man of broad views and knowledge, yet faithful to his training andhome. A high compliment to his native sod is, that a man of Mr. Payne'sintelligence should have traveled so much, and still have come back thereto live his years out."
(**) This date is wrong. His son John was born in 1814. There is amarriage of record of a John Payne to Mary Smith in St. Mary's Co . MD,on 20 October 1798. (Quotation is from MARRIAGES AND DEATHS, ST. MARY 'SCOUNTY MARYLAND 1634-1900 on page 234 citing Catholic Parish Records

SUMMARY:
We can be fairly sure that Richard Payne and Catherine Spalding arethe parents of Teresa Payne because of the record of Teresa's marriage toJohn Jenkins. The bond was signed by her brother Hillary. In readingthe above cited sources, we learned that many Paynes migrated to NelsonCounty,
KY., from St. Mary's County, Maryland. A check of those records revealedthe marriage of Richard and Catherine in that county on 22 May, 1802 . Weare speculating that he is the son of Basil Payne whose will was filedJanuary 29, 1811 and which mentions a son Richard.
The will of Basil Payne mentions a daughter, Margaret Edwards. Shewas married to Ignatius Edwards on 8 February, 1805, three years afterRichard and Catherine, at St. Francis Xavier Catholic Church in St.Mary's County. Check all church records for Richard's marriage.
NOTES:
Richard Payne is shown as a witness to a will executed in NelsonCounty, KY., in 1833. No cite.
In the Chronicles of St. Mary's, Vol 4, No. 7, July, 1956, thereappears a list of those citizens of St. Mary's County who, in 1778, tookthe oath of allegiance swearing fidelity to the new government as follows:

RESEARCH:
Under Hillary Payne, note shows deeds to him from William Payne in1832 and from Alexander Payne in 1856. They could both be related toHillary, possibly uncles. They are not in Basil's will however. Ilearned of the marriage of a Basil Payne and Sarah Mattingly inWashington Co., VA. , on or April 21, 1797. There is also a James Payne, aged 45 in the 1870 census of Washington Co., VA. Thus James would havebeen born in 1835.
