A letter dated August 20, 1958 from R. Sharpe France, County Archivist, Lancashire Record Office, County Hall, Preston, England, concerned a document in the Gerard muniments (DDGe. H.72). It is dated 1 1June 1728 and is a release in consideration of 21 pounds of all cla imto the New Hall estate, made by Gerard Slye, late of the Provinc e ofMaryland but now of the City of London, gent. to Legh Master o fNewhall, Esquire. In it he says that "Thomas Gerard died intestat eleaving issue three sons and one daughter, viz. Justinian, Thomas ,John and Susanna and that the said Justinian and Thomas died intestate and that the said John died intestate leaving issue a son and daughter who both died intestate and witout issue whereby the said Susanna became heir-at-law to her father the said Thomas Gerard and that said Susanna intermarried with one Robert Slye and died leaving issu eonly one son Gerrard Sly who is since dead leaving issue only one s onthe said Gerrard, party to these presents."

"Mrs. Henrietta Maria (Slye) Plowden was the daughter of Robert Gerard Slye, and his wife, who was Mrs. Mary (Boarman) Gardiner, daughter of William and Mary (Pile) Boarman and widow of Luke Gardiner. Robert Gerrard Slye was the son of Robert and Susannah (Gerard) Slye o fSt. Mary's County. Susannah Gerard was the daughter of Thomas Gera rdof England who come to MD in 1636 and his wife, Susannah Snow, sis terof Justinian Snow."
(JS Comments: Note the inconsistancy of the above two statements .The former (which probably has more weight) asserts that the descendancy was Thomas, Susanna m. Slye, Robert Gerard, Gerard. The latter by Jenkins asserts that the descendancy was Thomas, Susannah m Slye, Robert Gerard. According to other accounts, Robert Slye and Susannah Gerard Slye had Robert Gerard who married Jane --- who had Gerar dSlye who married Mary Boarman, consistant with the first statemen tabove. Also troublesome is Jenkins' assertion that Mary Boarman wa sa widow of Luke Gardiner (2865); see his notes. The Gardiner book , pg36, also says Luke Gardiner married Mary Boarman in 1723 and die d in1754; Gerard died in 1733; was Mary a bigamist?)

The following information was obtained from the grave markers in
the Mt. Calvary Catholic Cemetary in Cherokee, Iowa in the Smith family
plot. She is buried next to her parents as is her husband and daughter.
She married Leo C. Toner (1875-1959). Their daughter's tombstone reads:
"DORIS L. TONER, Minn. 6/3/03-12/24/45. Sgt. Coast Artillery, WW II."

Death certificate states born April 16, 1878, Iowa and died May 29 ,1957 in Long Beach, California. Father Christopher Smith, Ireland andmother Esther Brennan, Canada. She died at the Fountain GroveConvalescent Hospital of a cerebral hemorrage caused by hypertensiveheart disease. Burial was at Calvary Catholic Mausoleum, Los Angeles, CA., on June 1, 1957 by Sheelar-McFadden Mortuary.

Years of exhaustive searching has revealed nothing about the parentageof Esther Brennan. Family tradition indicates that her parents diedat a young age and that she was raised by a Catholic Priest and hisstaff in Quebec, Canada. How she met and married Christopher Smith,several years her senior, is not known; only that he immigrated fromIreland, probably during the famine. To date, we have been unable tolocate Christopher's immigration records, whether directly fromIreland to the United States, or via Canada.

Is is possiblethat James Benan is actually Ester (sic) "Brennan"'s father?

!BURIAL
Christopher Smith is buried in the Mt. Calvary Catholic Cemetary inCherokee, Iowa with his wife Esther and their son Bernard Smith.There are two granite markers about 50 feet east of the circular drivejust south of the 11th street gate and past the Pigott plot. Thelarger of the adjacent markers contains the large letters SMITH nearthe base and the face is engraved "CHRISTOPHER SMITH DIED May 7, 1884, Aged 65 Years. May his soul rest in peace. Amen."

NOTES:
Esther Brennan is shown as 18 years of age in the 1860 census ofBenton County, Iowa. They must have just arrived there. They livedthere for sixteen years. Their eldest child, Bernard, was born inBenton C o. in 1861. (A James Benan appears, age 63, born Ireland,appears in the 1860 census of Benton Co. as well. It is possible thatthere was a spelling error in entering his name and that he isEsther's father. This is speculation.) Their next six children wereborn there ending with Ellen born ca 1872.
There is a record of Christopher Smith in a map of Benton County dated1871 showing him owning 80 acres being the W 1/2 of the NE 1/4 ofSec24 TS 82 N, R 12 W. This property was sold by deed dated January25, 1875 to John Garbing (Garling) for Eight Hundred Dollars. And onMay 9, 1876 the above mentioned four acre parcel was sold to WilliamS. Fisher for Twenty Dollars.

Apparently, Christopher Smith and his family moved to Cherokee Co.about 1876 based on the aforementioned sales of property, the purchaseof their farm in Cherokee Co. and the birth records of their children.C hristopher is not in the 1885 Iowa census and Esther is shown as awidow . He bought 154.99 acres for One Thousand Twenty-two and 90/100Dollars from the Iowa Falls & Sioux City Railroad Company, or $6.60per acre, in November , 1875. He died 9 years later in 1884 and hiswife, Esther Smith, with the help of their oldest son, Bernard Smith,then 24 years of age, maintained the farm. On September 27, 1889, adeed to the same property was recorded from T. H. Steele and wife toEsther Smith for the consideration of Four Thousand Dollars, receiptof which was acknowledged. Perhaps it had been necessary for Estherto borrow on the farm and, rather than use a mortgage as security,title was transferred with the understanding that it would bereconveyed upon repayment.

The only record we have of Elias Smith relates to the settlement
of his estate in St. Mary's County Maryland.

on behalf of her husband James Smith, her son John Smith and
her daughter Ally Smith for sums left to them from the estate of
